Terms of Agreement Arctic North Oy / visitarcticnorth.fi

DEFINITIONS
“Arctic North Oy / visitarcticnorth.fi” is the marketing name for Pyhätunturin Ravintolat Oy.

RESERVATIONS & PAYMENT

* Accommodation, Transfer and Activity bookings are charged in full upon booking.
* The person who makes the booking must be of legal age.
* When booking snowmobile tours the person ensures that the driver holds a valid driver´s license. The driver of the snowmobile must be at least 18 years of age and in possession of a valid driver’s license in Finland. Finnish law prohibits driving a snowmobile under the influence of alcohol.
* Payment or invoicing details are required at the time of booking for payment.
* If the customer chooses to pay through invoicing the payment must be paid by the due date.
* The booking is considered confirmed when the booker has been charged.
* visitarcticnorth.fi reserves the right to cancel a reservation or booking if the invoice has not been paid by the due date, or if the customer has not sent his / her credit card details for confirmation.

CANCELLATIONS

All changes and cancellations need to be made by email to sales@visitarcticnorth.fi. A cancellation is considered as having occurred when visitarcticnorth.fi receives it in writing during office hours in Finland, by 16:00 local time. If a cancellation is received later than this time, it is considered to have been received the following day. The following cancellation policies apply according to whether the customer is cancelling an activity, accommodation, or multi-day holiday package.

If an individual customer cancels his or her Accommodation booking:

* Over 30 days prior to the beginning of the reservation period, 50 € office cost will be charged.
* 0 - 30 days prior to the beginning of the reservation period, 100 % of the amount will be charged.
* Special conditions apply for the following dates : 18 Dec – 5 Jan: 0 - 60 days prior to the beginning of reservation period, 100 % of the amount is charged.

If an individual customer cancels his or her Activity or Transfer booking:

* Over 7 days prior to the beginning of the reservation period, 50 € office cost will be charged.
* 0-7 days prior to the beginning of the reservation period, 100 % of the reservation will be charged.
* Special conditions apply for the following dates: 18 Dec – 5 Jan: 0 - 14 days prior to the beginning of reservation period, 100 % of the amount is charged.

If an individual customer cancels his or her Holiday package & Overnight Safari booking:

* 30 % deposit invoice must be paid for multi-day package programs and overnight safaris. Final invoice must be paid 30 days prior to arrival.
* Over 30 days prior to the beginning of the reservation period, 50 € office cost will be charged.
* 0 - 30 days prior to the beginning of the reservation period 100 % of the amount is charged.
* Special conditions apply for the following dates: 18 Dec – 5 Jan: 0 - 60 days prior to the beginning of reservation period, 100 % of the amount is charged.

IN CASE OF ILLNESS

Same cancellation policy applies than in regular cancellation cases.

INTERNET RESERVATIONS

Customers should print their own confirmation, invoice and terms & conditions for online bookings. The reservations system will send confirmation to the email address provided by the customer. Customer must ensure that he / she get the confirmation. visitarcticnorth.fi shall not be liable for failed reservations the customer must contact visitarcticnorth.fi immediately for assistance, if she / he do not receive the confirmation.

visitarcticnorth.fi will not be liable for failed internet/online reservations and will not guarantee that the service will still be available, in case this should happen.

If an online / internet booking is successful and a service is no longer available, visitarcticnorth.fi will offer a suitable available alternative or refund the full amount paid by the customer.

In addition to these reservation conditions, a customer making a reservation via the Internet also accepts the General Terms of Use of the website. Before making a reservation, the customer shall be responsible for reading the documents and the instructions for making a reservation.

PRICE CHANGES

visitarcticnorth.fi reserves the right to correct errors in the price information before the conclusion of the contract.

visitarcticnorth.fi reserves the right to change prices if unforeseen increases in the cost of supplies (including but not limited to oil, fuel, taxes or subservices) should occur.

INSURANCE & LIABILITY

Snowmobile Injuries:

Snowmobiles are insured as required by The Finnish Traffic Insurance Act. This insurance covers medical care for injuries to the driver and the passenger arising from accidents. Personal injuries and damages to other parties are fully covered according to The Finnish Traffic Insurance Act. Snowmobile safari participants are held liable for damages caused to snowmobiles. The self-liability amount is maximum 900 euros per snowmobile and per accident case.

Other Injuries:

visitarcticnorth.fi may only be held liable for personal injuries or material damage arising from accidents that have happened during the delivery of the offered services and which are caused by negligence of visitarcticnorth.fi employees or sub-contractors or by the provision of the faulty equipment. visitarcticnorth.fi is not liable for any accidental damage or injury which has to be indemnified under the travel insurance of a customer. Personal travel insurance is always highly recommended. Program services e.g. snowmobile and husky safaris can be physically demanding and the participants may be exposed to different kinds of physical strain. In case the Consumer is having any illnesses or disabilities (for instance heart disease, asthma, diabetes, epilepsy, back or hip problems) that could affect his / her ability to take part in the Services, or if she is pregnant, she / he should prior to participating any Services consult medical experts about her / his ability to participate in the Service in question. Should the Consumer have an illnesses or disability of this nature, he / she acknowledges that he / she participates in the Service at his / her own risk.

Animals:

All animals used in the Services (reindeer rides, horse rides and husky rides) are trained as far it is possible for the activity. However, behaviour of animals can never be fully predicted and therefore, in order to reduce risks, given safety and other instructions have to be obeyed.

Other terms and conditions:

The driver of a snowmobile has to be at least 18 years of age and in possession of a valid driving licence. Children under 12 years ride as passengers in a sleigh pulled by a guide´s snowmobile. Driving a snowmobile under the influence of alcohol and intoxicants is prohibited by Finnish law.

visitarcticnorth.fi and its suppliers reserve the right to change the routing and duration of all excursions if necessary according to the prevailing weather and snow conditions or if deemed advisable for the sake of safety and the comfort of the participants. visitarcticnorth.fi and its suppliers also reserve the right to discontinue a safari if a participant is seen as a potential danger to him/herself or to others or is in poor health.

visitarcticnorth.fi right to cancel the reservation:

If a participant is seen as a potential danger to him /herself or to others or is in poor health.
In the event of Force Majeure or unreasonable impairment of the Party’s operations due to a similar cause (including but not limited to war, strike, weather, lack of snow, or other natural condition etc.). In this case, the customer shall have the right to a full refund of the payment. If the total amount is not paid by the due date or if credit card details are invalid or not received.

Complaints & Applicable law:

All remarks and complaints concerning our services are to be informed during the service or immediately after the service in writing to visitarcticnorth.fi by email to: sales@visitarcticnorth.fi. The Contracting Parties shall strive to solve disputes concerning the Contract together through negotiations. In the event an agreement cannot be reached through negotiations disputes shall be carried out in the Rovaniemi district court. The Contract is bound by Finnish law. visitarcticnorth.fi shall not be liable for changes arising subsequent to this publication which are beyond our control. visitarcticnorth.fi reserves the right to make changes.

Terms of reservation of visitarcticnorth.fi:

The following terms apply to the reservations starting from 19th of March 2018. The terms are binding for both parties after the customer has made the payment stated in the terms of contract. The law governing these terms is Finnish law. If any possible disagreements cannot be resolved by negotiation, they shall be resolved in the Lapland District Court.

Reservations made in the online shop of visitarcticnorth.fi:

visitarcticnorth.fi online shop sells travel services for consumers (of at least 18 years of age), companies, and organisations.

Terms of payment and confirmation of reservation:

In the online shop you can pay by using your Finnish bank account or a valid credit card (Mastercard or Visa). When making an online shop reservation, the customer must always pay the entire price of the product by using a credit card or via a net bank. The price includes the products or services listed on the product card. The price can vary according to the time of reservation. The additional services that can be reserved together with the product are priced separately. Any reservation of additional services is binding. The reservation is confirmed when the total price of the product has been paid. After the customer has paid the reservation fee, the online shop shall send the customer the reservation confirmation, the reservation information, and the terms of reservation to the e-mail address provided by the customer. If the customer does not receive the reservation confirmation, the reservation has not been registered. The customer must store the reservation confirmation for possible later use (e.g. for insurance and liability matters). If the reservation should fail, the customer must contact the vendor as soon as possible to correct the situation. The vendor cannot guarantee that the item will still be available for reservation.

Payment Service Provider:

Checkout acts as a collecting payment service provider and is an authorized Payment Institution. Checkout will be shown as the recipient on your bank or credit card statement. Checkout will forward the payment to the merchant. For reclamations, please contact the website the payment was made to.

Terms of cancellation of visitarcticnorth.fi:

The cancellation must always be made in writing regardless of the method of reservation to the following address: Arctic North Oy, Ukonhattu 1, 98530 Pyhätunturi, FINLAND. The cancellation takes effect when Customer Service is informed about the cancellation. If the customer cancels the reservation more than 30 days before the start of the reservation, visitarcticnorth.fi shall with hold EUR 50 per reservation to cover its office and bank expenses. If the cancellation is made less than 30 days before the start of the reservation, the total rental fee shall be charged. If the reservation is cancelled before the start of the reservation due to sudden illness, accident, or death concerning the customer or his or her next of kind, the customer shall be entitled to receive a refund of the fee paid excluding the cancellation fee. The customer must inform Customer Service regarding this matter immediately and present a medical certificate, etc. If a cancellation due to one of the aforementioned reasons is made after the start of the reservation, the fee shall not be refunded. If the customer wishes to change the reserved service or the dates agreed, this change shall be considered both as a cancellation of the earlier reservation and as a new reservation. The customer does not have the right to make a cancellation or receive a refund of the reservation fee if one of the members of the customers party cancels his or her trip. Check your travel insurance coverage concerning cancellations. visitarcticnorth.fi may cancel the reservation in the event of force majeure. In this case, the customer shall be entitled to a refund of the entire rental fee paid. Any possible expenses caused to the customer due to the force majeure shall not be refunded.

General terms of contract concerning programme services:

Services and pricing

The prices of services and the programme descriptions are presented in the product-specific descriptions in the online shop. The prices include VAT.

Safaris shall be subject to change due to weather conditions and the programme content may vary as well. The service provider reserves the right to change the price, duration, and programme of the safaris without prior notice.

Pregnant women

Snowmobiling or sitting in a sleigh pulled by a snowmobile is not recommended for pregnant women. The vibration and exhaust gas from the snowmobile can be harmful to the foetus. If the safe performance of the programme requires special arrangements, the service provider shall be not responsible for the resulting additional costs.

Motor insurance

All motor vehicles used in the programme are covered by motor insurance.

Snowmobile safaris

The service provider reserves the right to change the order, routing and duration of the programme due to weather conditions, for example, or due to safety reasons.
The service provider reserves the right to exclude a customer from the programme, if he or she is considered to cause danger to him- or herself or others, or due to the customers health.

The driver of a snowmobile shall be responsible for compensating for possible damages caused to the snowmobile and related repairs to the amount of EUR 800.
The driver of a snowmobile must be at least 15-years-old and have a valid ‘T’ driving licence. In accordance with Finnish law, it is prohibited to drive a motor vehicle under the influence of alcohol or other intoxicating substance.

Personal travel insurance

Changes in prices

visitarcticnorth.fi reserves the right to correct any possible pricing errors. VAT shall be charged in accordance with the current taxation regulations.
